Contractors and motor carriers operating oversize or overweight vehicles on Pennsylvania highways must comply with state permit requirements, including the filing of a Pennsylvania Highway Oversize/Overweight Permit Bond (Form M-936B). This surety bond is a financial guarantee to the Commonwealth of Pennsylvania that the bonded party will pay all statutory and regulatory fees, costs, and expenses related to their permitted operations, as set forth in Title 67 Pa. Code – Chapter 179 and Chapter 19, Subchapter C of the Vehicle Code.
The bond is required by the Pennsylvania Department of Transportation (PennDOT) and must be submitted to the Central Permit Office. The minimum bond amount is $5,000, although higher amounts may be mandated based on the nature and volume of permitted operations. The surety must be authorized to transact business in Pennsylvania and must agree not to cancel the bond without written permission from PennDOT. The obligation remains in full force unless the bonded principal defaults on payment, in which case PennDOT may initiate immediate legal action, including confession of judgment.
